ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 22.11.2016 for the offences punishable under Sections 294 (b), 307 IPC and 3(1)(r)(s) SC / ST Act @ 294(b), 302 IPC r/w 3(2) (v) of SC / ST Act in Crime No.813 of 2016 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that during construction work, due to some dispute between the de facto complainant's father and the accused persons, they attacked the father of the de facto complainant with stone and thereby caused injury and thereafter, he died.
3.The learned counsel for the petitioners submitted that earlier bail application filed by the petitioners in Crl.O.P.(MD) Nos.23486 and 23621 of 2016 were dismissed by this Court on 20.12.2016 and investigation is almost completed. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate (crl.side) appearing for the respondent submitted that totally there are 2 accused in this case and initially case is registered against A2 and based on his confession, A1 is arrayed as accused in this case. He further submitted that the deceased died in hospital and investigation is still pending.
5.Considering the facts and circumstances of the case and also considering the fact that there is no change in circumstances after dismissal of the earlier bail applications of the petitioners, this Court is not inclined to grant bail to the petitioners. sd/- 25/01/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.)
