ORDER

The learned Counsel for the Petitioner submitted that the Petitioner is the de-facto Complainant. He had filed this petition seeking to transfer the investigation of the FIR in Crime No.351 of 2023 dated 14.03.2023 pending on the file of the third Respondent to the second Respondent for a fair and speedy investigation.

2. The learned Additional Public Prosecutor on instructions from the Respondents would submit after due investigation, it was found that there was no basis. Therefore, they dropped the case as mistake of fact and filed negative final report before the Court of the learned Judicial Magistrate No.V, Madurai with RCS No.227 of 2023 dated 30.11.2023.

3. Recording the submission of the learned Additional Public Prosecutor, the Petitioner is directed to approach the Court of the learned Judicial Magistrate No.V, Madurai and file appropriate petition, if he is so advised. On filing of such petition, the learned Judicial Magistrate No.V shall conduct enquiry and pass appropriate orders.
