ORDER
The present writ petition has been filed seeking direction to the respondents 1 to 4 to initiate departmental action for the act of misappropriation committed by the 5th respondent in the administration of college in disbursing salary to the 6th respondent without any authority whatsoever by considering the petitioner's representation dated 04.01.2024.
2. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.
3. The brief facts which are necessary for the disposal of this Writ Petition is as follows:- The petitioner was appointed as Lecturer in the Computer Department of the 4th respondent College. The petitioner alleges that an act of misappropriation has been committed by the 5th respondent in the Administration of College in disbursing the salary. Hence, the petitioner made a representation dated 04.01.2024 to the respondents 1 to 4 to initiate departmental action for the act of misappropriation committed by the 5th 3/6
respondent in the administration of college in disbursing the salary of the 6th respondent. Since the same was not considered by the respondents, the present writ petition came to be filed.
4. Heard, the learned Counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 3 and the learned Counsel appearing for the respondents 4 to 6. Carefully perused the materials available on record.
5. When the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 to 3 circulated a special Audit Report of the Director of Collegiate Education, Madurai dated 31.01.2024 wherein, it has been categorically observed that no disciplinary proceedings was pending as against the 5th respondent Principal regarding his administration of the 4th respondent College. Considering the fact that the petitioner had made a representation as early as on 04.01.2024 and the Special Audit Report of the Joint Director of Collegiate Education has given a clean 4/6
chit to the 5th respondent. I am of the considered view that nothing survives in this writ petition.
6. Accordingly, this Writ Petition stands closed. No costs. Consequently, connected miscellaneous petition is closed.
