ORDER : The Court Made the following order :- The petitioner, who is arrayed as the sole accused, in Crime No.55 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 13.08.2015, for the alleged offences punishable under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, and hence, seeks bail. 2.The case of the prosecution is that the petitioner was found in possession of 5.200 kgs of ganja.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and it is further submitted that the contraband is within the limit of less than commercial quantity.
4.The learned Government Advocate (Crl.side) would submit that the petitioner has no previous case.
5.However, considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional District and Sessions Judge/Presiding Officer Special Court for E.C and NDPS Act Cases, Pudukottai and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m., until further orders.
