O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] Seeking to suspend the sentence imposed on the petitioner by the learned Sessions Judge, Mahila Court, Pudukottai , vide Judgment dated 02.02.2023 in Spl.S.C.No.49 of 2022, the present Criminal Miscellaneous Petition has been filed.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner has failed to make out a prima facie case for grant of suspension of sentence since he has committed a very serious and heinous offence as against minor victim girl who is aged about 5 years, hence we are of the opinion that it is not a fit case for grant of suspension of sentence to the petitioner.

4. Accordingly this Criminal Miscellaneous Petition stands dismissed.

5. The petitioner's daughter marriage is fixed on 28.01.2026 at Pudukottai. Further the petitioner's wife has also submitted a representation before the Superintendent of Prison, Trichy to consider his representation seeking leave for her husband, which is pending for consideration.

6. In view of the above, the Superintendent of Prison, Central Prison, Trichy is directed to dispose the representation submitted by the wife of the petitioner in accordance with law by today itself.
