PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of declaration declaring the Amendment to section 16 of the Right of Children to Free and Compulsory Education Act, 2009 as notified in the Gazette of India dated 10.01.2019 on the file of respondent No.1 and the consequential G.O.Ms.164, School Education (MS) Department, dated 13.09.2019, on the file of the respondent No.3 as illegal and consequently direct the respondents to cancel the Public (Board) examination for 5th and 8th classes to be conducted at the state level.

[Order of the Court was made by M.DURAISWAMY, J.] The learned counsel appearing for the petitioner submitted that since the Government has already withdrawn the Government Order in G.O.(Ms). No164, School Education (MS) Department, dated 13.09.2019, the relief sought for in the writ petition has become infructuous.

Ms.S.Srimathy, learned Special Government Pleader appearing for the respondents 3 to 5, submitted that the Government has already withdrawn the abovesaid Government Order.

3. In view of the submissions made by the learned counsel appearing on either side, the writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petitions are closed.
