Sub Application filed under Section 151 of CPC to pass an order of interim injunction restraining the contemnors/respondent Nos. 2 and 4 from forcefully evicting the petitioner from his property from his patta land in

Survey No.271/23 situated at Kanchipurampatti Village, Alathur Group, Kilikudi Post, Illuppur Taluk, Pudukottai District pending disposal of the above contempt petition.

ORDER

(1)Notice to the respondents through Court as well as privately returnable by 11.02.2026.

(2)The learned counsel for the petitioner submits that despite the order of this Court dated 23.01.2025, directing the 4th respondent to conclude the enquiry and send a report to the 2nd respondent, within a period of four weeks from the date of receipt of a copy of the order and a further direction to the 2nd respondent to pass final orders within eight weeks, the respondents have not complied with the same. Contrarily, the respondents are trying to evict the petitioner by invoking the provisions of the Tamil Nadu Land Encroachment Act, 1905. The learned counsel submits that the notice of eviction was sent under the above Act on 29.12.2025 to the

petitioner and therefore, an order of injunction may be granted restraining the respondents from evicting the petitioner from his patta lands. (3)I find a prima facie case is made out and the balance of convenience is also in favour of the petitioner.

(4)Hence, there shall be an order of interim injunction restraining the respondents herein from evicting the petitioner from his patta lands in S.No.271/23 at Kanchirampatti Village, Alathur Group Kilikudi Post, Illupur Taluk, Pudukkottai District, till 11.02.2026. (5)Post on 11.02.2026.
