Criminal Original Petition filed under section 482 of Criminal Procedure Code, praying this Court to direct the Learned II Additional District Cum Sessions Judge (PCR Act Case) Tirunelveli to consider the bail application on his surrender on the same day if any petition filed by the petitioner in Crime No.163 of 2020 on the file of the 2nd respondent.

ORDER:- Criminal Miscellaneous Petition coming upon for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.G.Thalaimutharasu, Advocate for the Petitioner and of Mr.S.Chandrasekar, Additional Public Prosecutor for the 1st and 2nd Respondents, this Court made the following order: This Court, by its order dated 18.01.2021 in Crl.O.P.(MD) No.14544 of 2020 directed the petitioner to surrender before the learned Judge (PCR Act Cases), Thoothukudi, within a period of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD). No.987 of 2021 fifteen days from the date of receipt of a copy of the order.

2. The learned counsel for the petitioner would submit that the petitioner was not in a position to surrender before the concerned Court within the time stipulated by this Court and seeks further time to surrender.

3. Considering the request made by the petitioner, the petitioner is directed to surrender before the learned Judge (PCR Act Cases), Thoothukudi, within a period of fifteen days from the date of receipt of a copy of this order/uploading this order, failing which, the order passed by this Court, shall stand automatically cancelled, without further reference to this Court.

4. Accordingly, this Criminal Miscellaneous Petition is ordered.
