PRAYER :-For Bail in Crime No.1711 of 2018 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.1, who was arrested on 04.09.2021 for the alleged offence under Sections 147, 148, 341, 307, 379, 302, 201, 212, 120(b), 149 of IPC and 3(1) of TNPPDL Act, in Crime No.1711 of 2018 on the file of the respondent police, seeks bail.
2. The learned counsel appearing for the petitioner would submit that on 12.10.2020, due to illness, the petitioner was not able to appear before the learned IV Additional District and Sessions Judge, Madurai, in respect of the case in S.C.No.339 of 2019 and hence, non bailable warrant has been issued against the petitioner. He would further submit that the said absence is neither willful nor wanton and he undertakes that he will appear before the Court below regularly on all future hearing dates without fail.
3. The learned Government Advocate(Crl.side) would submit that the non bailable warrant has been issued against the petitioner on https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.2330 of 2022 12.10.2020 and the same was executed. He would further submit that the petitioner filed a bail application before the IV Additional District and Sessions Judge, Madurai in Cr.M.P.No.688 of 2021 and the same was dismissed on 10.11.2021 on the ground that the the petitioner has involved in six previous cases.
4. Considering the facts and the circumstance of his case and considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.Accordingly, this Criminal Original Petition is dismissed.
