ORDER

The petitioner's niece by name Manju @ Mahalakshmi passed away and it led to registration of Crime No.406 of 2021 on the file of Surandai Police Station under Section 174 Cr.P.C. According to the petitioner, the defacto complainant Vasanthakumar who is the husband of the deceased is actually the accused. Since the petitioner alleges that the case is not being investigated properly, he wants transfer of investigation.

2. When the matter was taken up for hearing, the learned Government Advocate submitted that final report has been made ready for closing the case as action dropped. Therefore, nothing survives https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.2332 of 2022 for adjudication in this Criminal Original Petition for the present. The third respondent is directed to serve the closure report on the petitioner before filing the same before the jurisdictional Magistrate. The jurisdicational Magistrate shall also serve notice on the petitioner herein. The petitioner is at liberty to file a protest petition. The jurisdictional Magistrate will take a call in the matter after hearing the petitioner. All the contentions of the petitioner are left open. This Criminal Original Petition is disposed of accordingly.
