The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 103 & 351(3) of BNS 2023,[u/s 294(b), 302, 506(ii) of IPC] in Crime No.616 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 31.12.2025 at about 07.40 p.m, the defacto complainant received a phone call that her brother was hacked randomly by all of the accused persons and she rushed to the spot and witnessed the same. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner he was not available on the place of occurrence and he left his house by 05.21 p.m. Hence, he prayed for anticipatory bail to the petitioner. 2/4

4. Therefore, this Court granted an opportunity to verify the same. Now it is reported by the prosecution that after verifying the CCTV footage it is seen these persons were present there. However, the prosecution shall not be able to pin point whether the petitioner is available or not. But the said fact has to be investigated further. In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition stands dismissed.
