ORDER : The Court Made the following order :- The petitioner, who was arrested on 10.01.2019 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C) of NDPS Act in Crime No. 2 of 2019 on the file of the respondent police, seeks bail.

2. It is the case of the prosecution that the petitioner is alleged to have found in possession of 21Kgs of Ganja

3. The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this case and he has nothing to do with the alleged offence. He would further submit that the petitioner have been in custody since 10.01.2019 and therefore, the petitioner may be granted bail.

4. The learned Additional Public Prosecutor submitted that this is the second bail application and the quantity involved in commercial quantity. He would also submit that there are two previous cases pending against the petitioner and he opposed to grant bail to the petitioner.

5. Taking into consideration, the nature and gravity of offence

and the quantity involved is commercial quantity and there is two previous case pending against the petitioner, I am not inclined to grant bail to the petitioner.

6. Hence the bail application is dismissed.
