ORDER : The Court Made the following order :- The petitioners, who are arrayed as A5 to A20 apprehend arrest at the hands of the respondent police, in pursuance of the NonBailable Warrant issued on 02.09.2015 by the learned Special Judge for TANPID Act cases, Madurai, in connection with a case in C.C.No.8 of 2015 for the alleged offences punishable under sections 406, 420 and 120(B) of IPC and section 5 of TANPID Act, in Crime No.2 of 2013 on the file of the respondent police and hence, seek anticipatory bail.
2.According to the prosecution, the accused were running a Chit Fund Company in the name and style of RMWC and by introducing attractive schemes, they have collected money from the depositors, but failed to pay the capital and profit to the depositors. https://hcservices.ecourts.gov.in/hcservices/
3.The learned counsel for the petitioners submitted that the petitioners were regularly appearing before the trial court and on 02.09.2015 due to their non-appearance, NBW was issued against them. The learned counsel further submitted that the petitioners undertake to appear before the trial court for all future dates without fail. 4.Heard the learned Government Advocate (Criminal side) appearing for the respondent.
5.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.
6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Special Judge for TANPID Act cases, Madurai and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judge concerned and the petitioners shall appear before the trial court in connection with a case in C.C.No.8 of 2015 for all future hearings without fail. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 7.The petitioners shall appear before the concerned Judge within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
