2015-02-04Honourable Mr Justice P. N. Prakash2 pages

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Wednesday, the Fourth day of February Two Thousand Fifteen PRESENT The Hon`ble Mr.Justice P.N.PRAKASH CRL OP(MD) No.1831 of 2015 REJANSON RAJAN ... PETITIONER/SOLE ACCUSED Vs STATE.REP.BY THE INSPECTOR OF POLICE AUTHOOR POLICE STATION, THOOTHUKUDI DISTRICT.

CR. NO.292/2014. ... RESPONDENT/COMPLAINANT For Petitioner : M/S.A.THIRUVADI KUMAR Advocate For Respondent : MR.A.P.BALASUBRAMANI,Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The case of the prosecution is that the petitioner had fabricated the Police Clearance Certificate dated 07.11.2014 and had joined at shipping company, Tutucorin.

2. The learned counsel for the petitioner submits that the petitioner has completed ITI course and aged about 20 years and he had approached a lady in Bombay, who had given him the said certificate. The learned counsel has produced the copy of the said certificate before this Court.

3. The learned counsel further submitted that on the face of the certificate it can be seen that the seal is in Hindi, whereas the certificate is purported to be given by the Superintendent of Police, Tuticorin. If it is really issued by the Superintendent of Police, Tuticorin District, seal would have been in Tamil or English definitely not in Hindi and therefore, he would submit that the petitioner himself is the victim of the crime. I am not able to persuade myself to agree with the submission because the fact remains that the petitioner has https://hcservices.ecourts.gov.in/hcservices/ approached a bogus person for getting the certificate knowing full well

that he should approach the Tamil Nadu Police for getting the said certificate. Therefore, arrest and custodial interrogation of the petitioner is essential to find out who is manufacturing the bogus certificate and issuing the said certificates.

4. Taking into consideration the allegation against the petitioner I am not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
