PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records relating to the Impugned Charge Sheet in SC No. 282/2018 on the file of the Learned I Addl District and Sessions Judge, Madurai, Quash the same as far as the petitioners are concerned, and pass such further or other orders.

ORDER

The present petition has been filed by Accused Nos. 1, 2, 4, 5, 11 and 13 in S.C. No. 282 of 2018, on the file of the learned I Additional District and Sessions Judge, Madurai, seeking to quash the charge sheet, wherein they are charged with offences under Sections 151 and 188 of the IPC and Section 3(1) of the TNPPDL Act, 1992.

2. A perusal of the charge sheet reveals that the petitioner, along with others, is alleged to have unlawfully assembled in protest against Government action. When they were arrested and taken in a bus, some of the accused persons are said to have damaged the bus to the extent of Rs. 2,000/-.

3. According to the learned counsel appearing for the petitioner, a false case has been foisted against the students. He relied upon a decision of this Court in a similar case, wherein similarly placed persons had filed Crl.O.P.(MD) No.20100 of 2018, namely K. Periyasamy, and the said petition for quashing the charge sheet in S.C. No. 282 of 2018 was allowed by this Court on 02.11.2018. 2/6

A perusal of the charge sheet clearly reveals that Petitioner Nos.1, 2, and 5 are similarly placed to the petitioner in Crl.O.P.(MD) No. 20100 of 2018, wherein there is an allegation of damage to public property. Insofar as the other petitioners, namely Petitioner Nos. 3, 4, and 6, are concerned, the allegations against them pertain only to unlawful assembly, and there is no allegation regarding damage to public property.

5. Since this Court has already quashed the criminal proceedings against one K.Periyasamy, who is similarly placed to Petitioner Nos. 1, 2, and 5, no useful purpose would be served in continuing the criminal proceedings against the present petitioners.

6. A perusal of the common order passed by this Court dated 02.11.2018 clearly reveals that the petitions have been allowed in respect of almost all the accused persons.

7. In such circumstances, the continuation of the criminal proceedings against the present petitioners alone would amount to an abuse of the process of law.

8. Considering the above said facts, the charge sheet in S.C.No.282 of 2018 on the file of the I Additional District and Sessions Judge, Madurai stands quashed. Accordingly, this Criminal Original Petition stands allowed. Consequently, connected miscellaneous petition is closed. 02.06.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No gvn 4/6
