Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus directing the 2nd respondent to produce the person or body of the detenue namely Stella Marry, W/o.Arulnathan, aged about 37 years, before this Court from the illegal custody of the respondents 3 to 17 and set her at liberty.

ORDER

[Order of the Court was made by S.VIMALA, J.] The petitioner is the husband of the detenu, who has filed this petition on the premise that the detenu is in the illegal custody of the respondents 3 to 17.

2.The respondents 3 to 17 believed that if the detenu is abducted and problem is created for her safety and security, that would be a factor compelling to the petitioner to settle the amount and on that belief, the detenu was abducted and kept in confinement for a period of four days and thereafter, at the intervention of Viralimalai Police, she was released from the custody. 3.The learned Additional Public Prosecutor appearing for the respondents would submit that the complaint regarding abduction is under investigation and necessary instructions would be given to the respondents 1 and 2 to complete the investigation and that the respondents 3 to 17 have already been instructed not to interfere with the liberty of the detenu.
