Heard the learned counsel on either side.

2. The private respondents wants survey to be conducted. The petitioner opposed the same on the ground that he has already filed an appeal before the first respondent.

3. The first respondent is directed to dispose of the appeal filed by the petitioner on 21.10.2019 on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order. Based on the outcome of the said appeal, the second respondent herein can take decision regarding survey.

4. This writ petition stands disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
