This writ petition is filed for writ of Mandamus, to direct the respondents 1 to 3 to disconnect the 4th respondent's electricity service connection in S.C.No.689 in S.No.41/1A, Door No.702, Valarikkadu, Pananvayal Group, Hamlet Village of Uthanvayal, Karaikudi Taluk, Sivagangai District.
2. The contention of the petitioner is that he has purchased the property through his vendors. The 4th respondent is the Watchman who was appointed by the petitioner for security purpose. The 4th respondent has obtained electricity connection without the knowledge of the 3/6
petitioner. Therefore, the petitioner is objecting to the granting of electricity connection.
3. Granting of electricity connection will not confer title, which is a settled proposition. Therefore, the 4th respondent cannot claim any title by getting electricity connection. If the petitioner and the 4th respondent have any land dispute, they can approach the appropriate forum for settling their issue.
4. The official respondents shall inform the 4th respondent that the said connection is granted without prejudiced to the rights of the writ petitioner, hence he shall execute an indemnity bond as per Regulation 4/6
27(4) of the Electricity Distribution Code. The 4th respondent is directed to execute the said indemnity bond as per the Regulation 27(4). With the above said observation, the writ petition is disposed of. No costs. Index : Yes / No 11.08.2023 Internet : Yes NCC : Yes / No Tmg 5/6
