PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 3rd respondent to conduct survey and measurement in respect of the land in survey No.14/7, Kondapethan Village, Madurai North Taluk, Madurai District, within a time frame by this Court and consequently direct the 4th respondent to give adequate police protection to the 3rd respondent for conducting the survey and measurement. 1/4

ORDER

This writ petition has been filed for issuance of a writ of mandamus, directing the third respondent to conduct survey and to measure the property within a timeframe fixed by this Court.

2. When the matter was taken up for hearing, the learned Special Government Pleader appearing on behalf of the respondents 1 to 3 submitted that the survey was conducted on 06.03.2021 and the property was also measured. The survey was conducted in the presence of the petitioner. However, the petitioner claimed that he is entitled for 0.20.00 ares and whereas after the completion of the survey, the petitioner refused to sign in the notice and co-operate. The relevant written instructions received from the Tahsildhar, Madurai East Taluk was also placed before this Court. 2/4

3. In view of the above, no further orders are required to be passed in this writ petition, except recording the submission of the learned Special Government Pleader by taking into consideration the written instructions received from the Tahsildhar. This writ petition is disposed of accordingly. No costs.
