ORDER

The petitioner complains harassment at the hands of the second respondent based on the complaint of the third respondent. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.

3. The learned counsel appearing for the petitioner submitted that earlier, the third respondent had preferred a complaint, on the basis of which, the second respondent had conducted preliminary enquiry and closed the matter. Now, the respondent police again started harassing the petitioner, based on the same allegation that was once enquired and closed.

4. The learned Additional Public Prosecutor submitted that since the closure report of the earlier complaint, the third respondent had moved the concerned Magistrate who has now directed the police to investigate the case under Section 156(3) Cr.P.C. In connection with the same, the petitioner is being invited for an interrogation / enquiry. The respondent police have neither harassed the petitioner nor intended to harass him.

5. The Statement of the learned Additional Public Prosecutor is recorded. Suffice to say for the present, the Investigating Agency is now required to issue summons to the petitioner to hold an https://hcservices.ecourts.gov.in/hcservices/

interrogation / enquiry. During enquiry, there shall be no harassment to the petitioner.

6. With the above direction, this Criminal Original Petition is disposed of.
