ORDER

The present petition is filed seeking protection to the petitioner's life, limb and liberty at the hands of the private respondents.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.

3. The learned Additional Public Prosecutor submitted that the petitioner and the private respondents are the trustees and there arose an intestate dispute between the trustees. Both have https://hcservices.ecourts.gov.in/hcservices/

preferred complaints. Acting on the same, the Investigating Agency has recommended the matter to the Executive Magistrate for initiating an action under Section 145 Cr.P.C.

4. The learned counsel appearing for the petitioner sought some time to explore the possibilities of settlement through the ongoing process to provide negotiation between the parties.

5. Suffice to say for the present, there does not appear to be any threat to the petitioner's life, limb and liberty for the present. Therefore, nothing survives survives in this petition. Accordingly, this Criminal Original Petition is dismissed.

6. If however the petitioner faces any threat perception, the petitioner will be at liberty to give a fresh complaint to the third respondent and on such fresh complaint, the third respondent is directed to enquire into the matter of the complaint filed by the petitioner and take such appropriate decision as may be necessary to protect the life, limb and liberty of the petitioner.
