PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd respondent Chief Educational Officer to approve forthwith the appointment of N.Jephia as Lab Assistant in the petitioner's school namely, Sarojini Memorial Higher Secondary School, Orappanavilai, w.e.f., 05.04.2023 and disburse the grant-in-aid towards her salary and allowance w.e.f., the said date.

O R D E R

The instant writ petition has been filed by the management of an aided minority stand alone institution seeking a mandamus, to direct the third respondent to approve the appointment of Lab Assistant.

2. A perusal of the records reveal that one N.Jephia was appointed as Lab Assistant in the petitioner's school on 05.04.2023. The management has forwarded a proposal to the third respondent herein by way of an order dated 05.07.2023. The proposal was returned for rectification of certain defects. Again, the proposal was resubmitted on 14.12.2024. Since, orders have not been passed by the authorities, the present writ petition has been filed. 2/4

3. Considering the above said facts, the third respondent herein is directed to consider the proposal submitted by the petitioner management dated 14.12.2024 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above said observations, this writ petition is disposed of. No costs.
