PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the second respondent to consider the petitioner's objection letter dated 08.09.2025 and 06.01.2026 for not to register any document in connection with Survey No.228/1 situated at Thiruppathur Village, Sivagangai District pending civil suit in O.S.No.80 of 2012, on the file of the District Munsif Court, Thiruppathur within a time frame as fixed by this Court.

O R D E R

The present Writ Petition has been filed seeking for a direction to the respondents to consider the petitioner's objection letter dated 08.09.2025 and 06.01.2026 for not registering any document in connection with Survey No.228/1 situated at Thiruppathur Village, Sivagangai District pending civil suit in O.S.No.80 of 2012, on the file of the District Munsif Court, Thiruppathur.

2.By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

3.Learned Counsel for the petitioner would submit that the subject property belongs to the petitioner's grandfather, whereas the respondents 3 to 8 have fabricated the documents and obtained patta in their name. In this regard, the petitioner's grandfather had filed a suit in O.S.No.45 of 2005, before the District Munsif Court, Thiruppathur. He further submits that the said suit was dismissed for default and they are now in the process of filing an application to restore the suit. While that being so, now the private respondents are making an attempt to register a sale deed and the petitioner has already given an objection to the second respondent in this regard. Hence, the present Writ Petition. 4.Learned Government Advocate appearing for the official respondents would submit that the respondents would consider the objection letters given by the petitioner, issue notice to the parties and thereafter, pass appropriate orders.

5.Considering the submission made by the learned Counsels, in the event of presentation of any sale deed with regard to the subject survey number, this Court directs the second respondent to consider the petitioner's objection letters dated 08.09.2025 and 06.01.2026, by issuing notice to the petitioner as well as other interested parties, hear them and thereafter pass orders in accordance with law.

6.Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
