Heard Mr.S.Arul Murugan for the petitioner.
2. This Civil Miscellaneous Petition is filed under Section 5 of the Limitation Act, seeking to condone the delay of 321 days, in filing the Civil Revision Petition as against the order passed in I.A.No.5 of 2024 in O.S.No.181 of 2022 dated 15.10.2024 pending on the file of the Principal District Court, Karur.
3. The respondent, though served, has not entered appearance in the condone delay application. The reason for the delay is that the petitioner is diabetic, which has resulted in a serious infection in his foot. The photographs enclosed by Mr.Arul Murugan indicate the seriousness of his condition. Furthermore, the petitioner is a senior citizen aged about 75 years.
4. I find that sufficient cause has been made out. The delay of 321 days is condoned, and the present Civil Miscellaneous Petition is ordered accordingly.
