arbitrary and consequently direct the first respondent to conduct an enquiry with the respondents 3 to 5 and other interested parties of R.S.No.15 of Kathakinaru Village, Thamaraipatti, Madurai East Taluk, Madurai District and thereby conduct a survey and fix boundaries of the petitioner's property to an extent of 17 cents situated in R.S.No.15 (Patta No.55) of Kadhakinaru Village based on the petitioner's father's registered sale deed in Document No.1472 of 1960 dated 26.06.1960, on the file of the Sub-Registrar, Thamaraipatti of Madurai District, within the time limit that may be stipulated by this Court. ORDER

The learned counsel for the petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to challenge the impugned order before the appellate authority and requests that the same may be directed to be disposed of within a time frame to be fixed by this Court. He has also made an endorsement to that effect.

2. Recording the aforesaid submission and the endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as withdrawn

with liberty as prayed for. No costs. In the event of the petitioner filing an appeal, the appellate authority is directed to dispose of the said appeal on merits and in accordance with law, after affording an opportunity of hearing to all the necessary parties, as expeditiously as possible.
