[Order of the Court was made by DR.G.JAYACHANDRAN, J.] This civil miscellaneous petition has been filed seeking to condone the delay of 173 days in the filing the above writ appeal.

2. Mr.A.Arputharaj, learned counsel, takes notice for the first respondent and Mr.K.Gnanasekaran, learned Government Advocate (Criminal Side), takes notice for the second respondent.

3. This matter relates to renewal of the passport issued to a person, who is facing a criminal case. Since the issue has already been referred to the Larger Bench and verdict is awaited, we are inclined to condone the delay.

4. Accordingly, this civil miscellaneous petition is allowed and the delay of 173 days in filing the above writ appeal is condoned.
