PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C to direct the 2nd respondent to expedite the investigation and file the final report in connection with Crime No.385 of 2008 on the file of the 2nd respondent within the time as may be fixed by this Court. ORDER
The petitioner seeks a direction to expedite the investigation in this case in Crime No.385 of 2008, which was registered on the basis of the complaint preferred by him for the offences under Section 379 and 506(i) IPC.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.
3. The learned Additional Public Prosecutor submitted that the case was referred to as mistake of fact on 13.05.2009, but conceded that the investigating officer has not intimated the petitioner about it.
4. In view of the above submission, the petitioner is now required to approach the concerned Magistrate Court. The respondent police are also directed to serve a copy of the final report to the petitioner. Accordingly, this Criminal Original Petition is disposed of.
