The petitioner, a retired Head Master of the Government Higher Secondary School, Thanjuvur District claiming revision of scale of pay, by calculating the period of service rendered by him at Kshatriya Vidhyasala Matriculation Higher Secondary School, Sulakkarai, Virudhunagar District for a period of 10 years and 5 months as a Geography Teacher, has submitted a representation on 21.06.2021 and filed this writ petition, seeking a writ of Mandamus. 2.Today(04.02.2026), when this writ petition is taken up for hearing, the learned counsel on either side submit that the petitioner has already filed a writ petition in WP(MD) No.8995 of 2/5
2018, challenging the order of the Chief Educational Officer, Thanjavur District in Oo.Mu.No.1667/Aa1/2017 dated, 27.04.2017 and the same has been dismissed for non-prosecution by this Court, by its order, dated 16.03.2023. Since the earlier writ petition was dismissed for non prosecution, the petitioner was not aware of the earlier order passed by this Court and has erroneously filed this writ petition.
3.Recording the aforesaid submissions made by either side counsel, this writ petition is dismissed with liberty to this petitioner to workout his remedy as against the order of this Court in WP(MD) No. 8995 of 2018, dated 16.03.2023. No costs. 04.02.2026 NCC: Yes/No Index:Yes/No vrn To 3/5
