PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C to direct the 1st respondent to provide adequate police protection to the petitioner and her family members for enjoying the newly constructed residential house in Survey No.25/1A to an extent of 1200 Sq.Ft situated at Sri Sowdambiga Nagar, Kathapparai Village, Manmangalam Taluk, Karur District based on her complaint with CSR No.34 of 2019 dated 30.03.2019.

ORDER

The petitioner claims protection to her life, limb, liberty and right to enjoy her newly constructed house in S.No.25/1A, Kathapparai Village, Manmangalam Taluk, Karur District.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.

3. The learned Additional Public Prosecutor submitted that the complaint preferred by the petitioner is pending enquiry in C.S.R.No.34 of 2019. He added that prima facie it appears to be a civil dispute.

4. So far as the petitioner perceives a threat to her right over her property, she has to approach the concerned civil Court. So far as the threat to her life, limb and liberty is concerned, the first respondent is directed to cause such necessary enquiry on the complaint preferred by the petitioner and take such appropriate decision as may be necessary to protect the life, limb and liberty of the petitioner.

5. With the above direction, this Criminal Original Petition is disposed of.

6. It is made clear that this Court does not order granting of

police protection 24 x 7 and the first respondent is left to decide on the basis of the objective assessment of the threat perception of the petitioner from time to time.
