(Order of the Court was made by PUSHPA SATHYANARAYANA, J.) The writ petition is filed challenging the order dated 09.12.2021 passed in Crl.MP.No.899/2021.

The petitioner has already filed S.A.No.54 of 2022 which is now pending before the Debts Recovery Tribunal, Coimbatore, and it is stated by the learned counsel for the respondent Bank that the said application is listed today. For the very same relief, the petitioner has now moved this writ petition. However, it is stated by the learned counsel for the petitioner that when he filed the writ petition, there was no Presiding Officer. 3.
In view of the above statement by the learned counsel for the Bank, the learned counsel for the petitioner seeks permission to continue with the prosecution of S.A.No.54 of 2022. 4.
