PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C to direct the learned Judicial Magistrate, Thuraiyur, to complete the trial in S.T.C.No.108 of 2013 within the stipulated time as fixed by this Court.

ORDER

The petitioner is the complainant in S.T.C.No.108 of 2013, instituted for an offence under Section 138 of the Negotiable Instruments Act. He seeks speedy disposal of the above said case.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.

3. The learned counsel appearing for the petitioner submitted that the case has been posted for arguments atleast thrice and every time, the respondent comes out with some application for halting the proceedings. He also added that speedy trial is not just entitlement of the accused, but also that of the complainant.

4. There is considerable merit in the submission of the learned counsel appearing for the petitioner. Therefore, this Court directs the learned Judicial Magistrate, Thuraiyur, to take note of the said statement and dispose of the trial within a period of two months from the date of receipt of a copy of this order. Accordingly, this Criminal Original Petition is disposed of.
