PRAYER :- To direction the respondent No.2 to withdraw the case in Crime No. 382 of 2019 dated 03.05.2019 on the file of the respondent No.4 and entrust the same to respondent No.3 for an investigation of the case by a competent Officer.

ORDER

This Criminal Original Petition is filed to direct the respondent No.2 to withdraw the case in Crime No. 382 of 2019 dated 03.05.2019 on the file of the respondent No.4 and entrust the same to respondent No.3 for an investigation of the case by a competent Officer.

2. The learned counsel appearing for the petitioner submitted that the petitioner is the de-facto complainant with the aforesaid crime which was registered with regard to the suspicious suicide of his daughter, who 2/8

was married to one Raja Durgesh on 25.08.2018. Within six months of their marriage on 03.05.2019, on suspicious circumstances, she had committed suicide. In this regard, the petitioner had been running between pillar and post before the various law enforcement agencies to conduct a fair investigation as to the dowry, physical and mental harassment suffered by the petitioner's daughter in the hands of her husband and in-laws. However, despite his persistent efforts, no progress was made in the investigation and ultimately, the case was closed as 'mistake of fact' by the fourth respondent.

Under these circumstances, the petitioner filed a protest petition before the jurisdictional Magistrate, pursuant to which the learned Judicial Magistrate passed an order directing the fourth respondent to conduct further investigation. However, even thereafter, no progress was made in the investigation. Consequently, the petitioner was constrained to approach this Court by filing Crl.O.P(MD)No.6391 of 2025, seeking transfer of the investigation to any other competent investigating agency. 3/8

This Court had passed a positive order directing the 4th respondent to conduct the investigation under the supervision of the Commissioner of Police, Madurai City and to file a report before the jurisdictional Magistrate. In compliance with the directions of the learned Magistrate, the petitioner has appeared before the respondent police on several occasions. However, the respondent police have remained sluggish and reluctant in taking any positive action, despite the grave plight of the petitioner. Hence the present petition has been filed.

Learned Government Advocate (Crl.side) submitted that pursuant to the order passed by this Court on 06.10.2025, a copy of the same was received by the fourth respondent on 01.11.2025 and thereafter on 03.11.2025 the petitioner appeared before the investigating officer. HIs appearance was recorded by the respondent police. Again rival party enquiry conducted by the respondent. Pending investigation, the petitioner made baseless allegations against the Inspector of Police and Assistant Commissioner of Police within a period of 20 days, made a representation without any valid records.

6. Heard both sides and carefully perused the materials available on record.

7. Considering the fact that the criminal original petition has been filed for the second time seeking transfer of investigation to any other competent investigating agency. It is further submitted by the learned Government Advocate that after receiving the order passed by this Court in Crl.O.P(MD)No.6391 of 2025 dated 06.10.2025, appropriate enquiry has been conducted by the learned Assistant Commissioner of Police, Thilagar Thidal Police Station, Madurai. Both the parties were enquired by the 4th respondent police. The petitioner had made a representation dated 16.12.2025 with unfounded allegations as against the investigating officer.

8. This Court hereby directs the Assistant Commissioner of Police, Thilagar Thidal Police Station, Madurai, to undertake the further investigation of the case directly and the second respondent herein is directed to monitor the same from time to time and the Assistant 5/8

Commissioner of Police is directed to appraise the progress of the investigation to the second respondent every Friday.

9. With the above direction, this Criminal Original Petition is allowed. Consequently, connected miscellaneous petition stands closed. 02.02.2026 NCC : yes / no Index :yes / no Internet : yes / no pnn 6/8
