PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- To enlarge the petitioners/accused Nos. 3 and 4 on bail in the event of arrest in pursuant to the NBW dated 19.02.2019 in P.R.C.No.15 of 2015 pending on the file of the Learned Judicial Magistrate No. II, Srivilliputtur, Virudhunagar District. ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 397 and 414 of IPC, in P.R.C.No.15 of 2015 pending on the file of the Learned Judicial Magistrate No. II, Srivilliputtur, Virudhunagar District, seek anticipatory bail.

2. The case of the prosecution is that the petitioners failed to appear before the Court, hence a non-bailable warrant was issued against them.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of 2/5

anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the petitioners failed to appear before the Court, hence a non-bailable warrant was issued against them. Therefore, he opposed the grant of anticipatory bail to the petitioners.

5. Considering the facts and circumstances of the case, this Court is directing the petitioners to surrender before the concerned Court and file a recall application. On such application, the concerned Judicial Magistrate shall consider the same in accordance with law on merits on the same day.

6. With the above said directions, this Criminal Original Petition is disposed of.
