Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned communication of the fourth respondent in Ref:010600/CRS/CRS - 172/12/2024, dated 13.05.2024 and quash the same as illegal and direct the respondents 3 to 5 to reimburse the medical expenses incurred by the petitioner towards her husband's medical treatment as per New Health Insurance Scheme along with interest within a time frame as fixed by this Court.

The instant Writ Petition has been filed by a Government servant, challenging the rejection order passed by the fourth respondent Insurance 2/5
Company, wherein the claim made by the petitioner seeking reimbursement for the expenses of the medical treatment undertaken by her husband has been rejected.
2. According to the learned counsel appearing for the writ petitioner, the rejection order has been made primarily on the ground that the treatment has been taken in a non-network hospital. However, according to him, the petitioner would be eligible to make a claim because the treatment was undertaken due to emergence situation.
3. Per contra, the learned Standing Counsel appearing for the respondents 3 to 5 submits that, in case, if the rejection order is passed by the Insurance Company, the claimant has to approach the District Level Empowerment Committee of the concerned District.
4. In view of the above said submissions, this Writ Petition stands disposed of with liberty to the petitioner to approach the concerned District Level Empowerment Committee to ventilate her grievances. In case, if any such appeal is filed before the said Committee, the same shall be disposed of 3/5
within a period of twelve weeks from the date of receipt of a copy of appeal. There shall be no order as to costs.
