ORDER

This Writ Petition has been filed to direct the second respondent to take action and dispose the petitioner's complaint in CSR No.43 of 2024 dated 07.02.2024.

The petitioner had sent a complaint to the second respondent stating that the respondents 3 to 5 have cheated the petitioner to the tune of Rs.12,00,000/- and further agreed to execute the sale eded with the collected money. Though the respondent police assigned CSR No.43 of 2024, no action has been taken.

3. The learned Additional Public Prosecutor submitted that on the complaint of the petitioner, CSR No.43 of 2024 assigned. The petitione was summoned and asked to produce supporting documents but the petitioner failed to produce the same, hence the complaint was closed on 07.02.2025. He further submitted that the fifth respondent also failed to appear for enquiry.

4. The learned counsel appearing for the petitioner, on instructions submitted that the petitioner is even now ready to appear before the respondent police on 05.02.2025 and produce all relevant documents .

5. In view of the same, the closure report in CSR No.43 of 2024 is set aside. The petitioner is directed to appear before the second respondent police for enquiry on 05.02.2025 with all relevant materials . The second respondent to ensure the presence of respondents 3 to 5 on 05.02.2024. The second respondent is directed to conduct enquiry in this regard and dispose of the same within a period of two months from 05.02.2025.

6. With the above direction, the Writ Petition stands disposed of. No costs.
