Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/A2 apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 307, 324 and 506(ii) IPC in Crime No.319 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2.The learned Counsel for the petitioner would submit that the petitioner is an innocent person and she has been falsely implicated in this case and hence, he prays for enlargement on anticipatory bail. He further submits that the occurrence took place on 24.08.2015 and the complaint given on 25.08.2015. He further submits that A1 already arrested and enlarged on bail before this Court in Crl.O.P(MD)No.18432 of 2015 on 25.09.2015.
3.The learned Government Advocate (Criminal side) submitted that the occurrence took place on 24.08.2015 and the case has been registered on 25.08.2015. He further submits that A1 already arrested and enlarged on bail on 25.09.2015 and the investigation is going on and however, she prays for dismissal.
4.Considering the rival submissions and on perusal of the typed set of papers the alleged occurrence took place on 24.08.2015 and the complaint has given on 25.08.2015 and A1 already arrested and enlarged on bail on 25.09.2015 and the investigation is considerably over, it is not a case of the prosecution that the petitioner will interfere with or absconding, I am inclined to grant anticipatory bail to the petitioner with certain conditions.
5. Accordingly, the petitioner is ordered to be released on bail in the event of her arrest or on her appearance before the learned Judicial Magistrate No.I, Thoothukudi, an on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only)with two sureties each for a like https://hcservices.ecourts.gov.in/hcservices/
sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall report before the Court concerned daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
