Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 380 of IPC, in Crime No.252 of 2015 on the file of the respondent police and hence, seeks anticipatory bail. 2.According to the defacto complainant the Head Master of Government Higher Secondary School, Mudivaithanendal, the accused have stolen 5 laptops worth of Rs.40,000/-.
3.The learned counsel for the petitioner submitted that the petitioner was working as a Clerk in the Government Higher Secondary School and the Laptop was in the custody of the other accused. It is further submitted that the similarly placed co-accused was granted anticipatory bail in Cr.M.P.No.2932 of 2015. It is further submitted that to show his bonafide, the petitioner is ready to deposit a sum of Rs.10,000/- to the credit of Cr.No.252 of 2015. 4.The learned Government Advocate (Crl.side) submitted that the petitioner has no bad antecedents and the co-accused has granted anticipatory bail by the Sessions Court.
5.Considering the above facts, this Court is inclined to grant anticipatory bail to the petitioner on condition that the petitioner shall deposit a sum of Rs.10,000/- (Rupees Ten Thousand only) to the credit of Crime No.252 of 2015 before the learned Judicial Magistrate No.I, Thoothukudi on receipt of the same the petitioner is entitled to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, Thoothukudi and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) https://hcservices.ecourts.gov.in/hcservices/
with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 06.00 p.m., for a period of two weeks and thereafter, as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
