PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 to take appropriate legal action against the respondents No.5 and 6, who are illegally running a petty shop without permission in petitioner's residential house situated at Survey No.l98/48, Chidambarapuram Village, Alagapuri Revenue Village, Thiruvengadam Taluk, Tenkasi District, and consequently direct to close the above said illegal shop based on the petitioner's representation dated 28.12.2025 within a stipulated time that may be fixed by this Court.

O R D E R

The present Writ Petition has been filed seeking a Mandamus as against the respondents 1 to 4 to initiate legal action as against the respondents No.5 and 6.

2. According to the learned counsel appearing for the writ petitioner, the respondents 5 and 6 are illegally running a petty shop without permission 2/5

in the petitioner's residential house. Therefore, the petitioner has given a representation on 28.12.2025 seeking the assistance of the official respondents to evict them.

3. The averments in the affidavit will clearly indicate that the petitioner is trying to evict the respondents 5 and 6 from his private property. He cannot seek assistance of the official respondents for the same and he has to approach the competent court to get eviction of respondents 5 and 6.

4. In view of the above said facts, the prayer sought of in the writ petition cannot be granted. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. 29.01.2026 NCC : Yes/No Index : Yes / No Internet : Yes / No ebsi 3/5
