ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders, to direct the first respondent that to provide adequate police protection to the life and limb of the petitioner and his association members by considering the petitioner's representation, dated 25.01.2023.

2. The learned Government Advocate (Criminal Side) appearing for the State would submit that on the basis of the complaint given by the second respondent, CSR.No.941 of 2022 came to be registered. Subsequently, the complaint given by the petitioner, C.S.R.No.1116 of 2022, came to be registered and on considering the fact that the dispute with respect to the property, directed the parties to approach the Civil Court and CSRs were ordered to be closed.

3. It is evident from the records that there existed property dispute between the petitioner and the second respondent. 2/4

4. Admittedly, there is no enforceable decree or order from the jurisdictional civil Court and as such, the granting of police protection does not arise at all. As of now, leaving open the petitioner's rights and remedies, this Criminal Original Petition is dismissed. 02.02.2023 NCC :
