ORDER

This petition has been filed seeking a direction to the respondents 1 to 3 not to harass the petitioner by the 4th respondent, based on the representation of the petitioner dated 21.01.2026.

2. The learned counsel appearing for the petitioners submitted that the petitioner was working as a lorry driver, who had been entrusted to lay gravel sand to one Kanthimathinathan. While unloading the sand, some dispute had arisen between the petitioner and one Tamilselvan. In this regard, on receipt of complaint from Tamilselvan, CSR No.68 of 2025 dated 11.01.2025 was issued to the defacto complainant by the fourth respondent. In this regard, he was called for an enquiry and after conduct of enquiry, an FIR in Crime No.32 of 2025 for the offence under Sections 296(b) and 351(3) of BNS, 2023 and Section 3 of TNPPDL was registered as against the petitioner. The petitioner is being subjected to harassment by the fourth respondent continuously. Hence, this petition came to be filed.

3. The learned Government Advocate appearing for the respondent police submitted that the petitioner was called for an enquiry only with regard to the FIR registered against him. Otherwise, the fourth respondent had never ever threatened him at any point of time and only to escape the clutches of law, this petition has been filed.

4. Heard the learned counsel on either sides and carefully perused the materials placed before this Court.

5. On perusal of the records, it is seen that there is no strong evidence of wrongdoing or harassment and hence, I do not find any merit in this petition. Accordingly, this criminal original petition stands dismissed. 29.01.2026 NCC : Yes / No Index : Yes / No Sm 3/4
