ORDER
This Criminal Original Petition has been filed seeking a direction to the respondents to provide police protection to the life and limb of petitioner against the life threat perceived from the respondents No.3 to 5 on the basis of complaint dated 28.03.2019.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal side) appearing for the respondents 1 and 2.
3.The learned counsel appearing for the petitioner would submit that the petitioner and the respondents 3 to 5 are relatives and the petitioner had obtained a separate drinking water pipe line from his house and the respondents 3 to 5 received separate pipe https://hcservices.ecourts.gov.in/hcservices/
line to their house. He would further submit that the petitioner's house and the respondents 3 to 5 house had been receiving poor level of drinking water, therefore, both the parties had approached the village panchayat and the village panchayat administration had asked both the parties to fetch the drinking water in equal proportion from the separate drinking water pipe line given to nearby church. He would further submit that whenever, the petitioner went to the church for collecting his share of drinking water from the pipe line, the respondents 3 to 5 prevented the petitioner from fetching the water and abused him filthy language and criminally intimidated him. Hence, the present petition has been filed seeking police protection before this Court. 4.The learned Government Advocate (Criminal side) appearing for the State would submit that they will suitably instructed the respondent police to take action.
5.Considering the facts and circumstances of the case and also considering the fact that this is a private dispute, the prayer in this petition filed under Section 482 of Cr.P.C., is not maintainable.
6.In view of the above, this Court is not inclined to grant relief to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
