ORDER

This Civil Revision Petition is filed to call for the records relating to the fair and decreetal order dated 06-01-2023 made in I.A.No.1 of 1/4

2022 in H.M.O.P.No.173 of 2017 on the file of the Sub Court, Aruppukottai and set aside the same.

2. Considering the fact that pending the revision, the amount directed by the Court below had also been paid and the arrears were deposited and the petitioner also continues to pay the maintenance amount, the interlocutory application filed by the respondent seeking to strike off the HMOP in which direction was issued, becomes infructuous.

3. In view of the same, learned Subordinate Judge, Aruppukottai, is directed to dispose of the HMOP No.173 of 2017 as expeditiously as possible, however not later than three months from the date of receipt of a copy of this order. Since the maintenance awarded has become final, the respondent is also permitted to withdraw the amount lying in the credit of the HMOP No.173 of 2017 before the Subordinate Court, Aruppukottai. It is made clear that the petitioner shall continue to pay the maintenance awarded without any fail and any failure on the part of the petitioner even for one month, will render the HMOP liable to be dismissed.

4. With the above direction, this Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition stands closed.
