O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second and third respondents to conduct a proper survey, measure and demarcate the petitioner's land comprised in Survey No.287/3A, Narippaiyur Village, Kadalai Taluk, Ramanathapuram District, on payment of the prescribed fees vide E-Challan No. 2025/0123/27/008063 dated 25.09.2025, with the assistance of the fourth and fifth respondents, within the time frame to be fixed by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6
3. The learned counsel appearing for the petitioner would submit that an online application has been submitted for the survey of the property in question and for demarcation of its boundaries.
4. The learned Additional Government Pleader appearing for the first to third respondents would submit that there is a civil dispute with regard to the subject property and that a civil suit is also pending before the competent Civil Court.
5. In response to the said submission, the learned counsel for the petitioner would submit that the petitioner is not connected with the said civil dispute and that even in the civil suit, the petitioner is not a party.

This Court is of the view that once an application is made for survey and demarcation of the property and the necessary payment is made, it is the bounden duty of the officials to consider the same and pass appropriate orders. Therefore, this Court directs the second and third respondents to consider the online application of the petitioner dated 25.09.2025, survey and demarcate the petitioner's land after considering the claims of all parties and pass orders in accordance with Sections 9 and Page No. 3 of 6
10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. If the issue is in fact involved in the civil suit, the same shall also be taken into consideration while passing any order. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners and other interested parties, if any and that if required, police assistance may be taken.
7. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
