PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. IN CRL.OP.(MD).NO.18687 OF 2015 ORDER : The Court Made the following order :- The petitioners, who are the accused in Crime No.235 of 2015 for the offence punishable under Sections 147, 148, 323, 324, 336, 294(b), 307 IPC r/w Section 3(1) of PPDL Act, on the file of the respondent Police, were arrested and remanded to judicial custody on 31.08.2015. They seek bail.
2.The prosecution case is that on 30.08.2015 at about 17.00 hours, the petitioners / accused shouted slogans against a leader of a communal party from hoisting a flag and attacked the de facto complainant's party and also caused damage to the tune of Rs.3 lakhs. 3.The learned counsel for the petitioners submitted that based on the compliant given by the 1st petitioner, a case was registered against the de facto complainant's party in Crime No.234 of 2015, in which, the de facto complainant is the first accused. The learned counsel for the petitioner further submitted that the accused were conducting awareness camp relating to prohibition of liquor and also arranged for a programme addressed by a political leader, which was objected by the rival community party and thereafter, the petitioners have been falsely implicated in this case.
5.The learned Government Advocate (Crl.side) appearing for the respondent objected for granting bail to the petitioners and submitted that the petitioners have taken law into their hands and committed a heinous crime and also damaged the property worth of Rs.3 lakhs. 6.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.side) appearing for the respondent. 7.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.
III, Thanjavur and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m., until further orders and each of the petitioners are also directed to deposit a sum of Rs.5000/- to the credit of Crime No.235 of 2015. sd/- 30/09/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
