ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 448, 427, 294(b), 341 and 506(i) of IPC, in Crime No.437 of 2015, on the file of the respondent police and hence, seeks anticipatory bail.

2.According to the defacto complainant, he was running a private car parking in the name and style of MSR Car parking at Tuticorin in the lands belonging to St.Mary's College, while so, the accused have tresspassed into the place and illegally took the possession and also attacked the watchman and other four persons.

3.The learned counsel for the petitioner submitted that the petitioner was issued licence to run a car parking under the tenancy agreement in the year 1998 and St.Mary's College attempted to evict the petitioner by illegal means and therefore, he laid a suit in O.S.No.416 of 2013 and when the Civil Suit is pending, a false complaint was given against the petitioner.

4.Heard the learned Government Advocate (Crl.side) appearing for the respondent.

5.Considering the above facts, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate No.II, Thoothukudi and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent https://hcservices.ecourts.gov.in/hcservices/

police daily at 06.00 p.m., for a period of two weeks, and thereafter, as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
