ORDER
The present petition has been filed by the 9th accused in Crime No.666 of 2025 on the file of the respondent police station wherein the petitioner is alleged to have committed the offences under Section 303(2), 336(2), 336(3) and 340(2) of the Bharatiya Nyaya Sanhita (BNS) 2023.
2. An F.I.R has been registered on 27.09.2025. A perusal of the F.I.R reveals that the petitioner's lorry has been used for transportation of minerals to Kerala with fake transit passes.
3. According to the learned counsel appearing for the petitioner, the vehicle has been given on rental basis to the 8th accused who had transported the minerals with this kind of fake documents and therefore, he is not aware of the usage of fake transit passes.
4.The learned Government Advocate (Crl.side) appearing for the respondent submitted that the petitioner was implicated in a similar case on 08.08.2025 and the F.I.R as against him was quashed by this Court in Crl.OP(MD).No.16093 of 2025 on 17.10.2025 and therefore, the petitioner is aware of the fact that even as on 08.08.2025 that his vehicle is being used by the contractor for illegal transportation of minerals. 5.The primary contention of the learned counsel appearing for the petitioner is that he had rented out the vehicle to the 8th accused who is the quarry owner for transportation of minerals and he is not aware of the usage 2/4
of fake transit passes by the 8th accused person. This is a disputed fact and it has to be found out in the investigation during investigation process. This fact cannot be canvassed before this Court for quashing of the F.I.R. 6.In view of the above said facts, this Criminal Original Petition stands dismissed.
