O R D E R

The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure, seeking a direction to the Judicial Magistrate, Palani to dispose the case in Cr.M.P.No.4561 of 2012 in M.C.No.16 of 2008 pending on the file of the Judicial Magistrate, Palani within a time frame as fixed by this Hon'ble Court.

2. Heard the submissions made by the learned counsel appearing on either side.

The learned counsel for the petitioner would submit that the petitioner along with his mother filed M.C.No.16 of 2008 on the file of the Judicial Magistrate, Palani and the learned Sessions Judge directed the respondent to pay a sum of Rs.5,000/- as maintenance and since the respondent has not paid that amount, the petitioner filed Cr.M.P.No.4561 of 2012 in M.C.No.16 of 2008 which is pending. Hence, he wants early disposal.

4. Considering the submission of the learned counsel for the petitioner, this court is of the view that it is a fit case for giving direction to the Judicial Magistrate, Palani. Accordingly, the learned Judicial Magistrate, Palani is directed to dispose of the petition in Cr.M.P.No.4561 of 2012 in M.C.No.16 of 2008 within a period of three months from the date of receipt of copy of this order.
