Order : This Appeal coming on for hearing on this day, upon perusing the Petition of Appeal the Record of the evidence and Proceedings before the said Court of Session/said Lower Court and upon hearing the arguments of Mr.N.MOHIDEEN BASHA, Advocate for the Appellant/Accused Nos.1 to 3 and of Mr.C.RAMESH, Additional Public Prosecutor on behalf of the State this Court has ordered as follows:-
1) That the Criminal Appeal (MD)No.135/2016 be and is hereby partly allowed herein
2) That the Conviction and Sentence imposed on the first appellant/first accused by the Judgment dated 2.3.2016 made in S.C.No.304/2015 passed by the Ist Additional District and Sessions Judge, Thoothukudi is hereby confirmed and the Criminal Appeal against the First Appellant/First Accused be and is hereby dismissed
3) That the appeal against the Appellants 2-3/Accused 2 and 3 is hereby allowed and the Conviction and Sentence imposed on the appellants 2 and 3/accused 2 & 3, be and is hereby set aside and appellants 2 & 3/Accused 2 &3 are acquitted
4) That the fine amount , if any, paid by the Appellants 2&3/Accused 2 and 3 shall be refunded to them
5) That the Appellant 2&3/Accused 2 and 3 are directed to be released forthwith, unless their custody is required in connection with any other case.
