ORDER : The Court made the following order :- The petitioner/Accused No.1, who apprehends arrest at the hands of the respondent police for offences punishable under sections 126(2), 127 (2), 296(b), 115(2), 118(1), 351(3) and 303 (2) of BNS, 2023 in Crime No.463 of 2024 on the file of the respondent police, seeks anticipatory bail.
2. Earlier anticipatory bail petition filed by the petitioner was dismissed on merits by an order dated 19.01.2025 in Crl.O.P.(MD).No.321 of 2025. This Court does not find any change in circumstances. This Court cannot deal with the case on merits every time an anticipatory bail petition is filed before the Court. Therefore, just because the rule of res judicata will not apply for anticipatory bail petition, that does not mean that the Court will deal with the case every time on merits. Unless there are change in circumstances, the Court will not entertain the second anticipatory bail petition.
