ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 69 of BNS in Crime No.251 of 2025 1/4

on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the de facto complainant and Accused No.1 were in a relationship, and on the basis of a false promise of marriage, Accused No.1 had physical relationship with her on several occasions. Subsequently, Accused No.1, in collusion with the other accused persons, refused to marry her and demanded jewels and other articles. Hence, a case has been registered.

3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) strongly opposed to grant anticipatory bail to the petitioner. Further, A1 is arrested and A3/2nd petitioner is a history sheeter who has 9 previous cases against him.

5. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the 2nd petitioner, this Court is not inclined to grant anticipatory bail to the 2nd 2/4

petitioner at this stage.

6. Accordingly, this Criminal Original Petition is dismissed as far as the 2nd petitioner is concerned.

7.As far as the petitioners 1 and 3/A2 and A4 are concerned, the petitioners 1 and 3 shall be released on own bond. Accordingly, this Criminal Original Petition is closed as far as the petitioners 1 and 3 are concerned. 16.02.2026 TMG TO 1.The Inspector of Police, Pathamadai Police Station, Tirunelveli District.
